LBH Medan Criticizes Belawan Police Chief Over Failure to Arrest Suspect in Alleged Sexual Violence Case

CRITICISM AGAINST BELAWAN POLICE: LBH Medan criticizes the Belawan Police Chief after no arrest has been made against suspect Syafril Armansyah, Head of Rumah Sakit Prima Husada Cipta Medan, in an alleged sexual violence case.

MEDAN | INDATANEWS.COM - The Legal Aid Institute of Medan (Lembaga Bantuan Hukum Medan/LBH Medan) has criticized the actions of the Belawan Police Chief for failing to arrest suspect Syafril Armansyah, also known as Syafril, who is allegedly involved in a sexual violence case and currently serves as the Head of Rumah Sakit Prima Husada Cipta Medan.

LBH Medan considers the police handling of the case questionable. The organization has particularly highlighted the complaint filed by the alleged victim, identified by the initial S, under report number LP/B/780/X/2025/SPKT/POLRES BELAWAN POLDA SUMUT dated October 2, 2025, which has yet to be declared fully completed or assigned P21 status.

The Director of LBH Medan, Irvan Saputra, S.H., M.H., stated that the alleged victim is a nurse at Rumah Sakit Prima Husada Cipta Medan who has worked at the hospital since 2015 until today. According to him, the victim allegedly experienced repeated acts of sexual violence between January and June 2023, which were allegedly committed by Syafril Armansyah within his workplace environment.

LBH Medan Questions Handling of Investigation Process

Irvan explained that the victim initially disclosed the alleged incidents to a fellow healthcare worker in the nursing department. However, according to him, the disclosure did not receive an appropriate response.

"After the incident, the victim told a colleague from the nursing department about what happened. However, the victim's experience did not receive an adequate response or was apparently considered something ordinary," Irvan said.

Following this, the victim reported Syafril Armansyah to the Belawan Police. The report was registered under LP/B/780/X/2025/SPKT/POLRES BELAWAN POLDA SUMUT dated October 2, 2025.

During the investigation process, Syafril Armansyah was named a suspect for the alleged criminal act of sexual violence. The designation was based on Article 6 letter C in conjunction with Article 15 letters D and E of Indonesian Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS). These provisions carry a maximum penalty of 12 years imprisonment and/or a fine of up to Rp300 million.

According to Irvan, LBH Medan has long been committed to law enforcement and human rights protection while also advocating for the interests of victims. The organization suspects that the suspect may have received preferential treatment because the police have not carried out an arrest.

"In addition, the victim's report has still not been upgraded to P21 status. This may indicate an alleged violation of the Criminal Procedure Code (KUHAP), particularly related to possible obstruction of justice and an unreasonable delay in the process without legal certainty," Irvan said in an official statement on Tuesday, July 14, 2026.

Demand for Immediate Arrest of Suspect

Irvan emphasized that investigators should immediately detain the suspect because sexual violence is considered an extraordinary crime.

"Based on Article 100 of the Criminal Procedure Code, detention should be imposed on the suspect, especially since this involves a sexual violence crime. However, this has not been carried out by the police chief and his staff," Irvan said.

Apart from questioning the progress of the victim's report, LBH Medan also criticized the counter-report filed by Syafril Armansyah against the victim over an alleged defamation offense.

Irvan stated that such action contradicts the spirit of protecting victims and whistleblowers in sexual violence cases. He referred to Article 69 letter G of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, which provides protection for victims and/or whistleblowers from criminal or civil lawsuits related to reported sexual violence cases.

"This provision is also reinforced by Article 10 of Law Number 31 of 2014 concerning Witness and Victim Protection. It stipulates that victims and whistleblowers cannot be prosecuted criminally or civilly if their reports are made in good faith," Irvan explained.

LBH Medan Issues Five Demands

Following the situation, LBH Medan has submitted several demands to law enforcement authorities and related parties.

First, LBH Medan urged the Belawan Police Chief to immediately order the arrest of Syafril Armansyah alias Syafril. Second, the organization demanded that the Belawan Police Chief and investigators accelerate the investigation process of the victim's report until it reaches P21 status and is transferred to the prosecutor's office.

Third, LBH Medan called on investigators from the North Sumatra Regional Police (Polda Sumatera Utara) to stop the counter-investigation against the victim by considering applicable legal provisions.

Fourth, LBH Medan requested Rumah Sakit Prima Husada Cipta Medan to ensure a protection mechanism for the victim and witnesses involved in the case.

Fifth, LBH Medan demanded that the North Sumatra Police conduct an examination of investigators handling the case regarding possible violations of the Indonesian Police Professional Code of Ethics (Kode Etik Polri).

LBH Medan emphasized that the handling of sexual violence cases must be carried out professionally, transparently, and with legal certainty for victims. The organization hopes law enforcement authorities will ensure victim protection and complete the legal process in accordance with applicable regulations. (IDNC)
