MEDAN | INDATANEWS.COM - The Medan Legal Aid Institute (Lembaga Bantuan Hukum Medan/LBH Medan) has urged the North Sumatra High Prosecutor's Office (Kejaksaan Tinggi Sumatera Utara/Kejatisu) to immediately investigate alleged violations of the prosecutors' code of conduct and take action against the reported officials.
The reported prosecutors are investigating prosecutor Indra Zamaksari, SH, and Head of the Section for Crimes Against Persons and Property (Kasi Oharda), Andri Dharma, SH., MH. Previously, LBH Medan submitted complaints regarding alleged violations of professional conduct regulations within the Prosecutor's Office to the Inspectorate General of the Indonesian Attorney General's Office (Jamwas Kejagung) and the Indonesian Prosecutors Commission (Komjak RI) on March 12 and 13, 2026.To date, LBH Medan has criticized Kejatisu for failing to provide legal certainty and information regarding the progress of the internal investigation into the reported prosecutors.
Deputy Director of LBH Medan, Muhammad Ali Nafiah Matondang, SH., M.Hum, stated that based on information from the Indonesian Prosecutors Commission, LBH Medan's complaint had been officially registered.
The complaint was registered under number RSM.0219/LAP/IV/2026 on April 10, 2026. Following the registration, the commission discussed the case during a plenary meeting and decided to send a letter to the North Sumatra Prosecutor's Office.The commission subsequently issued a recommendation to Kejatisu through letter number R-161/KK.K/5/2026 dated May 13, 2026. However, the recommendation is still awaiting a response from the relevant working unit.
"After LBH Medan's complaint was recommended for immediate follow-up by Kejatisu, there have still been no actions and no legal certainty from Kejatisu, particularly from the Supervision Division (Aswas), which is handling this case, even four months after the report was submitted," Ali Nafiah said in an official statement on Friday, July 25, 2026.
Ali Nafiah explained that LBH Medan had requested information on the progress of the investigation into the alleged violation of the prosecutors' code of conduct from Kejatisu in early June 2026.
At that time, the Kejatisu Supervision Division (Aswas) informed LBH Medan that the complaint had entered the case examination stage.According to Ali Nafiah, Aswas Kejatisu also stated that the actions of the prosecutor handling the case had exceeded reasonable limits because the investigation files had been returned up to five times with the status of "incomplete" (P19).
LBH Medan considers this process inconsistent with Article 33 of the Regulation of the Attorney General Number 015 of 2013 in conjunction with Article 1 Paragraph 6 and Article 24 of the Regulation of the Prosecutor's Office of the Republic of Indonesia Number 4 of 2024 concerning the code of conduct and procedures for examining violations of prosecutors' professional ethics.Under these regulations, case examinations involving complaints that have gained public attention at regional or national levels must be completed no later than 14 working days. The authorized institution must either impose disciplinary action or terminate the examination process.
"What is particularly concerning is that after several months, Kejatisu has not imposed sanctions against the reported prosecutors and has also failed to provide legal certainty or information regarding the continuation of LBH Medan's complaint," Ali Nafiah stated.
Ali Nafiah explained that the complaint regarding alleged violations of the prosecutors' code of conduct originated from the handling of an alleged embezzlement case reported by Arjoni, a mother of two children who is believed to be a victim of a criminal act.
The case was registered under Police Report Number STTLP/B/909/V/2021/SPKT/POLDA SUMUT dated May 21, 2021. In the case, Heri Rahman, the victim's former husband, was named a suspect by the North Sumatra Police.The suspect determination was later challenged through a pretrial motion filed by the accused at the Medan District Court. However, the court rejected the motion through Decision Number 20/Pid.Pra/2025/PN Mdn.
"After being named a suspect and after the pretrial request was rejected by the Medan District Court, investigators repeatedly submitted the case files to the prosecutor in charge and the Head of Kasi Oharda. Nevertheless, the files were still not declared complete (P21)," Ali Nafiah said.He further explained that investigators and the victim had fulfilled various instructions from the Prosecutor's Office, including submitting expert opinions from criminal law experts and Islamic legal scholars. In addition, Arjoni had provided two witnesses along with supporting documents.
Despite these additional materials and repeated submissions of the investigation files, the Prosecutor's Office continued to declare the documents incomplete or P19. LBH Medan believes that returning the files up to five times contradicts applicable criminal procedure regulations."Therefore, from a legal perspective, LBH Medan has reasonable grounds to suspect that Kejatisu, through Aswas, is protecting its own members and has not acted professionally in handling the complaint regarding alleged violations of the code of conduct by the two prosecutors," Ali Nafiah said.
LBH Medan emphasized that every citizen has the right to protection, legal certainty, and fair treatment as guaranteed by the 1945 Constitution, the Human Rights Law, and internal regulations of the Prosecutor's Office.LBH Medan urged Kejatisu to immediately take firm action against the reported prosecutors to prevent similar violations of the code of conduct in the future and ensure that no further victims emerge.
